2.- PURPOSE AND ACCEPTANCE

This text (the “Privacy Policy”) governs the collection and processing of the personal data that you provide to us via e-mail or forms on this website. Therefore, when you visit this website as a user or customer (the “User”), you are automatically bound to comply with this Privacy Policy, which implies that you have read, understood and unreservedly accept the legal notices available on this website including the ADIC Conditions of Use, which we recommend you read when you access this website.

ADIC reserves the right to amend this Privacy Policy at any time. Therefore, the text may have changed the next time you access this website.

This Privacy Policy, any other legal notices and any amendments thereof, take full effect on the date of publication on the website. Therefore, as the User, we enable you to print out and store them.

3.- WHY DO WE PROCESS YOUR PERSONAL DATA?

The purpose of the collection of your data by ADIC is to use it in any of the following circumstances:

– SUPPORT

We may use your personal information to support products and services that you have obtained from us, i.e. we may notify you of an update or repair of a product. 

– CONTRACTING

Should you request from us a product or service, the information you provide to us will be used solely for the processing, management and, where appropriate, billing of the service requested, through the creation of a registered user account which you can access through the website. The data will be retained for the period of time strictly necessary for legal purposes. To make processing easier, we may share information with third parties such as the financial institutions, shipping companies, postal services or administrative bodies generally involved in that processing.

– EMPLOYMENT AND QUERIES REQUEST

Should you send any job queries or applications, whether in response to an advertisement on the ADIC website or for any other reason, you must provide us with your information, i.e. in the form of a CV. We may use this information in considering your job application or query. Unless you tell us otherwise, we will retain this information for future consideration.

– MARKETING

 The information you provide to ADIC and the information we collect about you may also be used by ADIC for marketing purposes. The information provided may be used by ADIC to send you our newsletter, product announcements and other information relating to ADIC.

However, before doing so, we will offer you the opportunity to choose whether or not we use your information for this purpose. At any time you may choose not to receive marketing materials by following the unsubscribe instructions included in the emails you receive, by telling us when we contact you, or by notifying us directly at the address contacto.iic@iic.uam.es.

– USE OF INFORMATION IN THE SOCIAL SOFTWARE ENVIRONMENT

ADIC offers social software tools in some of its websites to enable online collaboration between the members registered to use them. These tools include forums, blogs and other social media platforms.

When you register to use them, you will be asked to provide certain personal information to ADIC. The registration information not automatically offered to other participants as part of your profile will be subject to this privacy statement and protected by it.

Any other content you post, such as pictures, information, opinions or any other type of personal data that you make available to other participants on these social platforms, will not be subject to this privacy statement. Such content will be subject to the conditions of use of those platforms, to the privacy information and to the additional guidelines provided in connection with its use, which you should check to get a better understanding of your rights and obligations, the rights of obligations of ADIC and the rights and obligations of third parties with respect to such content. Be aware that the content you post on any of those social software platforms may be made available to other persons within ADIC and beyond.

ADIC will guarantee the accuracy and veracity of the personal data collected. Therefore, on its own initiative or at the behest of the User, ADIC will complete, rectify or delete any incomplete, inaccurate or outdated personal data.

Persons under the age of 14 may not provide any information to ADIC without the consent of a parent or legal guardian. Neither may they contract without such consent, unless permitted by the legislation in force.

4.- HOW LONG WILL WE RETAIN YOUR DATA?

– INFORMATION ON SUPPORT AND CONTRACTING

Your personal information will be retained during the term of the contract, as long as you do not request the deletion of your data, and for the period governed by the statute of limitations on any lawsuits which may arise in connection with this contract and any claims we may receive from official agencies such as the Spanish Inland Revenue and/or the Department of Social Security. In any event, no data will be retained for more than 5 years from the moment of termination of the contract.

– INFORMATION FOR THE SENDING OF MARKETING COMMUNICATIONS

Personal data provided for the sending of marketing communications will continue to be retained once the contractual relationship is terminated until you revoke your consent, without prejudice to your rights of deletion or opposition.

– EMPLOYMENT AND QUERIES REQUEST

Personal data provided will be retained until you request its erasure or for the 6 months following the last confirmation of interest.

– USE OF INFORMATION IN THE SOCIAL SOFTWARE ENVIRONMENT

Personal data provided through social software tools will be retained for at most 2 years.

5.- WHAT IS THE LEGAL BASIS FOR PROCESSING YOUR DATA?

– SUPPORT AND CONTRACTING

The legal basis for the processing of your data lies in our need to manage, develop and control the contractual and commercial relationship to which you are a party. Any data we request of you is mandatory. Therefore, failure to provide it may make the provision of the services we offer through our website impossible.

With regard to the sending of marketing communications by electronic means resulting from a previous contractual relationship, the legal basis lies in the legitimate interest of ADIC under Article 21.2 of the Information Society Services Act.

– JOB APPLICATION

The legal basis for the processing of your data lies in the unequivocal consent provided by the data subject through the acceptance of this privacy policy.

– MARKETING

The legal basis for the sending of marketing communications by any means, including electronic, beyond any contractual relationship, lies in the consent requested of you and freely provided by you at the time. Should ADIC fail to gain your consent, it undertakes not to process your data for advertising purposes.

– USE OF INFORMATION IN THE SOCIAL SOFTWARE ENVIRONMENT

The legal basis for the processing of your data lies in the unequivocal consent provided by the data subject when registering for the different applications.

6.- WHAT ARE YOUR RIGHTS WHEN YOU PROVIDE US WITH YOUR DATA?

Rights:

You have the right to obtain confirmation as to whether ADIC is processing personal data concerning you, and in that case, the right of access to your personal data, to the purposes of the processing, and to the personal data categories concerned.

Furthermore, you will have the right to request rectification of inaccurate data or, where appropriate, request deletion when the data is no longer necessary for the purposes for which it was collected; when consent to the processing has been withdrawn or the processing is opposed; when the personal data has been processed illegally; or when the personal data must be deleted to comply with a legal obligation of the European Union or the Member States.

You may apply for the limitation of the processing of your data when you dispute the accuracy of the personal data during the term permitted to the data controller to verify its accuracy; when the processing is illegal and the data subject opposes the deletion of the personal data and requests instead the limitation of its use; when the data controller no longer needs the personal data for the purposes of processing but the data subject needs it to formulate, file or defend claims; and when the data subject opposes processing while it is checked whether the legitimate reasons of the data controller prevail over those of the data subject. In such cases, we will only retain the data for the filing or defending of claims.

In certain circumstances on grounds related to your particular situation, you may oppose the processing of your data. ADIC will refrain from processing the data unless for compelling legitimate reasons or unless it needs to file or defend claims.

ADIC will have the right to receive your personal data provided by you in a structured format, and to transfer it to another data controller without it impeding the data controller to which it has been provided, whenever the processing is based on consent or whenever the processing is automated.

When the persons concerned wish to exercise their rights of access, rectification, deletion and opposition, limitation of processing and data portability, or their right not to be subject to automated individualised decisions, they must send an e-mail to derechosrgpd@iic.uam.es

7.- WHO WILL BE THE RECIPIENTS OF YOUR DATA?

ADIC may transfer your personal data to website hosting service providers, shipping companies, postal services and other third parties necessary to providing the services contracted. In each case a legal agreement will be signed guaranteeing compliance with this Privacy Policy and the other obligations contained in the applicable legislation in force borne by those third parties to whom personal data is provided or transferred, or compliance with a legal obligation.

Furthermore, whenever there is a legal obligation to do so, data may be transferred:

– To the police and security forces of the state (by court order);

– To the judges and the courts in compliance with legal requirements or obligations or in the context of court proceedings;

– To the banks for the management of recoveries and payments;

– To the Tax Authority for compliance with tax obligations;

– To any other third party who under the applicable legislation in force in each case may need to receive the data, such as the government bodies responsible for supervision, registration and inspection.

However, if at any time in the business relationship it is necessary to transfer your data to third parties for new purposes, that transfer will be performed whenever ADIC has your prior consent to do so in the legally required form.

8.- ARE THERE ANY INTERNATIONAL DATA TRANSFERS?

We do not perform any international transfers of your personal data. Furthermore, our internet server is hosted in the ADIC data centre located in Madrid and therefore in Spain. No international data transfer is performed beyond the scope of the European Union. Access to that Data Centre is restricted solely to authorised personnel.

9.- APPLICABLE LEGISLATION

ADIC hereby informs you as the User that both the processing of your personal data and the sending of our marketing communications by electronic means conform to the data protection legislation in force and the Information Society Services and E-Commerce Act 34/2002, of 11 July.

10.- SECURITY MEASURES

Under the legislation in force, we hereby inform you that ADIC has taken the appropriate technical and organisational measures to guarantee the security of the data and protect it from unauthorised alteration, loss, processing or access depending on the state of the technology, the nature of the data and the possible risks to which it is exposed.
