General Terms & Conditions

1.1 Welcome to the Internet Website owned by the Asociación para el Desarrollo de la Ingeniería del Conocimiento (referred to in this document as “ADIC”, “we” or “us”), a Spanish company located in Spain at Universidad Autónoma de Madrid, Campus de Cantoblanco, Ctra. de Colmenar Viejo km.15, C/ Francisco Tomás y Valiente 11, EPS. Edif. B, 5ª planta, 28049 Madrid. ADIC was registered at The National Register of Companies with reference: Grupo: 1/Sección: 1/Número Nacional: 593050, and Tax ID Number G-79/251716.

2. Object and Acceptance

2.1 This text (“General Terms and Conditions”) regulates both the use of contents and the hiring of services that we offer through ADIC website. When a visitor, customer or user (hereinafter, the “user”) accesses the website he or she is automatically binding on the acceptance of these General Terms and Conditions, which implies that he or she has read and understood and then so fully accepts the legal notices and the Privacy Policy available in our website, which we strongly recommend you to read.

2.2 ADIC reserves the right to modify the present text at any time which implies that it may have suffered some changes when you access the website anew. These General Terms and Conditions, as any other legal notices and the changes on them, are in force from the moment of their publication on the website. As user you have the possibility to print and store them.

3. Privacy and Personal Data Protection

3.1 ADIC is committed to respecting the privacy of your personal data, and we advise you to read the text on our Privacy Policy in order to understand our compliance relating the privacy and protection of your personal data. The user is informed that such legal notice is referred to and so included in these General Terms and Conditions.

4. Description and Conditions of the Services

4.1 All the products and services that appear in our website are described in the corresponding webpage, where we have included at least the minimum information needed about the service and product characteristics for the user to know what exactly they are.

4.2 ADIC reserves the right to update, modify or delete the information contained in our website www.iic.uam.es;  we also reserve the right to deny or limit access to said information without previous notice or even to cancel the access to ADIC webpage, particularly, when, as the case may be, technical problems may appear due to facts or circumstances beyond our control that are considered to interfere the standard security measures adopted to ensure the adequate running of our webpage.

5. Contents and copyright

5.1 For informational purposes only, texts, logos, images, databases, software, source code and other contents of the ADIC website are owned by ADIC or, in its case, by the particulars or companies named to be their authors or holders, therefore any breach  of copyright and patents rights will be pursued in accordance with the applicable legislation in force.

5.2 ADIC grants the user, as private citizen, a limited, temporal and non-exclusive license to access, consult and responsibly use our website. Thus the user is not allowed to reproduce, run, alter, distribute or communicate publicly via any media totally nor partially the data contained in this website except for purposes other than gathering information or hiring our services. The user is allowed to download this website or the contents in it exclusively in the cache memory of the unit in use, nonetheless it is not permitted to do it using robots, spiders, trackers or any similar tool to extract data that could imply an unjustified overload of the traffic in our servers with the corresponding damage for the rest of users; it is not permitted either the use of any instrument that could damage or unable our infrastructure, or that of third parties.

5.3 Users of our website must comply with the terms, conditions and legal notices that appear on it. Nonetheless, any software or content available on it to be accessed, downloaded or used in any other way with their own terms of use and legal notices will be governed by them.

5.4 Any comments, information, material, feedback or ideas regarding ADIC, as any products or services provided will be NON confidential and ADIC will have a free irrevocable non-restricted license to copy, reproduce, publish, upload, exhibit, communicate, pass on, publicly show, run, modify and create works derived from it, and to freely use this information or material in the more convenient way.

5.5 Users declare that they will not use our website to distribute, link or request any content considered to be defamatory, illegal, false, or against third parties copyright or privacy rights. In the same way, they state not to falsify their identities or impersonate or supplant any other person or entity.

6. Nullity and unenforceability

ADIC informs the users that given the case that any clause in these General Terms may be declared null and void or held unenforceable by a Court, Judges or an administrative competent entity, the nullity or unenforceability will only affect to such clause or part of it and not to the whole so the rest of the General Terms will be maintained.

7. Hypertext links to third parties’ web sites

Linked websites are not under ADIC control so if users decide to access any of them it will be at their own risk and responsibility. ADIC DENIES ANY IMPLICIT OR EXPLICIT WARRANTY REGARDING ANY LINKED WEBSITE, INCLUDING BUT NOT LIMITED TO THE EXACTITUDE, PROPERTY, VALIDITY OR LEGALITY OF SUCH CONTENTS INCLUDED IN THE LINKED WEBSITES THAT COULD BE ACCESSED FROM OUR WEBSITE.

8. Disclaimer of Warranty

All the materials, information, products, software, programs and services are provided “JUST AS THEY ARE”, without any warranty including, without limitation, the warranties of merchantability or fitness for a particular purpose.

9. Limitation of liability

9.1 In no event ADIC will be liable to any party for any loss or damage of any type that may result from accessing and using this website including, without limitation, those that may be caused by software, viruses or computing attacks. Even in the case ADIC might have been informed of the possibility of said damages. ADIC will not be responsible either for the damages produced by misuse of our website, nor for the connection, interruptions or defects in the access to this website.

9.2 ADIC will not be liable for the veracity, integrity or updating of the information contained in other websites linked from iic.uam.es, that may have been made available for the users as an alternative source of information. Such linked websites will be governed by their own terms of use issued by their owners being ADIC not liable for the possible damages resulted from the use of such information. ADIC will never be considered as to recommend, sponsor, or distribute the information, services and/ or products contained in such hyperlinks, belonging to third parties, and offered or popularized by them.

9.3 ADIC does not guarantee that the information contained in this website is correct, updated or complete. Likewise, ADIC has no obligation to update the information in this website.

10. Applicable Law

These General Terms are subject to the provisions pursuant: Act 7/1998 of April 13th on the standard contracting conditions; Act 26/1984 of July 19th on consumers and users defence; Royal Decree 1906/1999 of December 17th on the regulations of telephone and electronic contracting general conditions; Act 15/1999 of December 13th on protection of personal data;  Act 7/1996 of January 15th on the retail trade regulation; Act 34/2002 of July 11th on society of information services and electronic commerce;  Act 44/2006 of December 29th on improvement of consumers and users protection; and any other related  law that could be of similar application if necessary. 

 11. Applicable Legislation and Competent Jurisdiction

11.1 Users are here advised by ADIC that these General Terms and the relationship established between us, the parties, will be governed by the provisions of the Spanish legislation.

11.2 Likewise, the resolution of any dispute or claim derived from the interpretation of these General Terms and Conditions will be brought to the jurisdiction of the Courts and Tribunals of the City of Madrid, with expressed waiver of any other jurisdiction which may correspond to them.
